Introduction
In this document, the term 'Customer' refers to the final guest, as opposed to the subscription Contract between UNIRIDE and the property
This Rental Liability (hereinafter also "Liability" or "Contract") exclusively regulates the temporary use of Uniride's electric bicycles by the final Guest, within the e-mobility service made available to Uniride's partner accommodation facilities.
This Liability applies exclusively to rentals booked through the Hotel Partner channel indicated during online booking, with pickup and return at the same reception. For rentals booked through other channels (direct online rental, Quick Rent), Uniride's general Terms and Conditions of Service and the related Rental Agreement apply, available at uniride.it/policies.
Between
Uniride, as identified above ("Lessor"),
and
the final Guest (hereinafter "Customer" or "Guest"), identified by means of:
• personal, contact, and payment details provided during online booking (order placed on Uniride's e-commerce platform);
• identity document presented at the partner hotel reception at check-in and/or upon bicycle pickup, for the purposes of mandatory registration pursuant to Article 109 of TULPS.
the following is agreed and executed.
Art. 1 — Subject
1.1. The Lessor grants the Customer temporary use of an Uniride-owned pedal-assist electric bicycle, in the model indicated at the time of booking and with the frame number recorded in Uniride's system at the time of assignment to the Customer.
1.2. The rental includes: safety lock with key, protective helmet, and any additional accessories indicated in the order. The bicycle is delivered with a fully charged battery, and the Customer is not permitted to use the charger during the rental period. All bicycles are equipped with an active GPS tracking system.
1.3. Use of the bicycle is permitted exclusively by the Customer identified in the introduction, for the agreed duration and within the limits of this Contract.
Art. 2 — Term and consideration
2.1. This rental lasts for the period indicated in the booking order (for example: 1 hour, 3 hours, full day or another agreed duration) and starts from the actual delivery time at reception.
2.2. The consideration is the amount indicated in the booking order, collected by Uniride through its online payment system upon order confirmation. Any discount codes applicable to guests of the partner property are indicated in the order itself.
2.3. No security deposit is required from the Customer. The Customer's liability for damage, improper use, or theft of the bicycle during the rental is governed exclusively by Arts. 6 and 7 of this Contract.
Art. 3 — Delivery and return
3.1. The bicycle is delivered at the reception of the partner hotel indicated during booking, upon presentation of the pickup code generated with the order and a valid identity document.
3.2. At delivery, reception staff limit themselves to visually verifying that the bicycle is intact and functional. The Customer must check the bicycle's condition at the time of delivery and immediately report any cosmetic or mechanical defect by contacting Uniride's support service. In the absence of prompt reports by the Customer, the bicycle is presumed to have been delivered in perfect working order and condition.
3.3. Uniride retains photographs of the bicycle's condition archived before being made available at reception, which may be used as a reference for checking the delivery and return conditions.
3.4. Return takes place at the reception of the same partner hotel, by the date and time indicated in the order. The bicycle must be returned clean, intact, functional, and complete with all received accessories. Reception staff limit themselves to visually verifying that the bicycle is returned in the same condition as delivered; any discrepancies found are reported to Uniride.
3.5. In case of delayed return, the penalties set out in Appendix 1 apply. If 12 (twelve) hours pass from the scheduled return time without the Customer returning the bicycle or agreeing in writing to an extension of the rental, this constitutes a serious breach pursuant to Article 1382 of the Italian Civil Code, and the Customer is required to pay the maximum penalty of € 1,500.00 plus the amount due for the delay period.
3.6. Failure to return the bicycle constitutes embezzlement pursuant to Article 646 of the Italian Criminal Code, and the Customer will be reported to the competent Judicial Authority.
Art. 4 — Age, use by minors, and Customer obligations
4.1. The Customer signing this Contract must be at least 18 (eighteen) years old.
4.2. Use of the bicycle by minors is permitted only under the following conditions:
a) the minor must be accompanied throughout the entire use by an adult of legal age, parent, or legal guardian, identified as the Customer signing this Contract, who assumes full responsibility for the minor's conduct and safety;
b) the signing Customer declares that they have verified the minor's physical and technical suitability to use the bicycle and undertakes to constantly supervise its use;
c) the use of the protective helmet by the minor is strongly recommended in all circumstances;

c) not transport adult passengers or heavy, bulky, or dangerous loads;
d) protect the bicycle by using the supplied lock at every stop;
e) remove the battery in the event of prolonged parking in a public place;
f) not modify the bicycle in any way or remove or alter logos and devices;
g) not sublet or transfer the bicycle to third parties for any reason whatsoever;
h) not take the bicycle outside Italian national territory, without prejudice to the obligation to return it at the reception of the delivery partner hotel by the agreed time;
i) declare their physical and technical suitability to use a pedal-assist e-bike;
j) not use the bicycle on terrain with a slope greater than 15%;
k) return the bicycle within the agreed time at the reception of the same partner hotel.
Art. 5 — GPS and processing of location data
5.1. All Uniride bicycles are equipped with a 24/7 active GPS tracking system used exclusively for anti-theft, safety, and service management purposes.
5.2. The Customer declares that they are informed of the existence of the GPS system and expressly authorizes Uniride to process location data in accordance with EU Regulation 679/2016 (GDPR). Data are retained for a maximum of 30 days and will not be shared with third parties, except upon request by the competent Authorities.
5.3. Tampering with, disabling, or removing the GPS device entails a penalty of € 200.00, without prejudice to further damages.
Art. 6 — Liability for damage, improper use, and theft during the rental
6.1. The Customer is solely responsible for any damage, improper use, or theft of the bicycle occurring during the rental period. This provision operates in implementation of the subscription contract between Uniride and the partner hotel, which expressly excludes from the partner's theft coverage thefts occurring during rentals to final guests, leaving the matter to this Liability.
6.2. Theft and loss. In the event of theft or loss of the bicycle, the Customer must:
a) immediately notify Uniride at support@uniride.it no later than 12 (twelve) hours after the event;
b) file a formal report with the competent Authority within 24 (twenty-four) hours of the event and send a copy to Uniride.
6.3. Once the recovery procedure is activated through Uniride's GPS system: if the bicycle is recovered within 48 (forty-eight) hours from the report, no penalty is due from the Customer for theft, without prejudice to reimbursement of any confirmed damages. If the bicycle is NOT recovered within 48 (forty-eight) hours from the report, the Customer must pay a penalty of € 1,500.00 as compensation for failure to return the vehicle. If the vehicle is recovered after payment of the penalty, UNIRIDE will refund the amount paid to the Customer, net of any confirmed damages.
6.4. Partial damage. For partial damage to the bicycle, the Customer must reimburse the actual repair cost, up to a maximum of € 1,500.00.
6.5. Damage resulting from force majeure or proven manufacturing defects remains the responsibility of the Lessor.
6.6. Specific penalties for loss or damage to individual accessories are indicated in Appendix 1.
6.7. Damages discovered after return. Any damage to the bicycle discovered after return will be communicated to the Customer within 7 (seven) days from the return, accompanied by photographic documentation and, where necessary, a repair estimate. The Customer will be required to pay the relevant amount upon issuance of a regular invoice or fiscal receipt by Uniride, to be settled by bank transfer within 30 (thirty) days of receipt of the notice. No automatic charges will be made to the payment card used for the rental.
Art. 7 — Liability towards self, third parties, and property
7.1. The Customer is solely responsible for any damage caused to themselves, third parties, or property during use of the bicycle.
7.2. The Lessor is not liable for accidents, injuries, or indirect damages suffered by the Customer or third parties while using the bicycle.
7.3. The Lessor does not provide third-party liability coverage: the Customer rides under their own exclusive responsibility and must verify any insurance coverage active in their name.
Art. 8 — Maintenance and assistance
8.1. Ordinary maintenance of the bicycle is handled by Uniride through the partner hotel's staff, according to the procedures agreed in the subscription contract between the two parties.
8.2. For any technical problem encountered during the rental, the Customer may contact Uniride's remote support service at the number indicated on the brochure delivered at reception, available from 9:00 a.m. to 6:00 p.m. every day, including holidays.
8.3. Any repair intervention performed by parties other than Uniride or the partner hotel's authorized staff will not be reimbursed by the Lessor and results in the loss of any warranty on the bicycle.

9.2. Communications via SMS, WhatsApp, social networks, or phone calls will not be considered valid for contractual purposes.

Art. 14 — Child seat (optional)
14.1. If the order includes the child seat provided by Uniride (Thule model certified EN 14344, limited availability and bookable at the time of order), the following special conditions apply:
a) the child seat is intended exclusively for transporting one (1) minor whose weight and height do not exceed the limits indicated in the manufacturer's technical sheet attached to the seat itself;

c) the Customer is responsible for properly securing the minor to the seat with the supplied safety belts and for checking their operation before departure;
d) the use of a protective helmet by the transported minor is strongly recommended in all circumstances;
e) the Lessor is not liable for any damage caused to the transported minor, third parties, or the bicycle arising from use of the child seat not in compliance with the manufacturer's instructions, this Contract, or the applicable Highway Code provisions;
